Update on Exposing Election Fraud

Details

First, I need to clarify a couple things:

 (1) SR 410 and HR 1094 are not joint resolutions.  HR 1094 is a simple resolution and SR 410 is a concurrent resolution.   

 (2) According to Article II, Section 2 in the PA Constitution the General Assembly’s “term of service shall begin on the first day of December next after their election.”  However, members have to be sworn in before they can take action on any bills, resolutions, etc.  According to the PA Constitution Article II, Section 4 the General Assembly “shall meet at 12 o’clock noon on the first Tuesday of January each year.”  New members will be sworn in then! (Note:  Senator Mastriano has begun an effort to change the PA Constitution to allow for December session days, if needed.)

Article II, Section 4 also gives the right of the majority in both the State House and the State Senate to petition the Governor to call a Special Session.   If a majority in both House and Senate join the petition, the Governor “shall” or MUST convene a Special Session.  If a majority in the House and Senate do not join the petition,  the Governor may call a Special Session, “whenever in his opinion the public interest requires.”  Article III, Section 12 limits the Special Session to the one(s) designated in the Governor’s proclamation calling for the session.

Unless a Special Session is called, SR 410 and HR 1094 must be reintroduced after the 2021-2022 legislative session begins the first part of January.  At that point, they would, more than likely, be issued new numbers.

Representative Daryl Metcalfe and thirty-one other State House members have begun the effort of petitioning Governor Wolf for a Special Session.  It contains a list of 15 reasons Governor Wolf should call a Special Session.  Apparently only 32 State Reps see any problem with the way the November 3rd election was handled and had enough courage to sign onto the letter to Governor Wolf!

Action Steps

If your State Rep is not on the list of signers to the letter to Governor Wolf, contact him or her and ask why!  Election integrity should not be a partisan issue, so contact your State Rep no matter what party they are!  Ask him or her to contact Representative Metcalfe to sign on.
