Courts are misinterpreting Section 230 of the Communications Decency Act to allow websites which facilitate sex trafficking not to be held accountable. Worst yet was the First Circuit Court ruling in Doe v. Backpage which held that even if Backpage had participated in the crime of sex trafficking, Section 230 shielded the company from the claims filed by child victims! This misinterpretation must be stopped and Congress has a chance to fix it!
Come October 1st who will control the internet? If it’s up to President Obama, it will not be the United States of America! He is poised to relinquish control, held by the US since the beginning, to an international body where the First Amendment means nothing!
The current battle stretches back a year, when a federal appeals court struck down the Federal Communication Commission’s previous net neutrality rules, written by President Obama’s law school buddy and then-FCC Chairman Julius Genachowski.
In its ruling, the court effectively told the FCC that it had the authority to police traffic on the Internet, but that its rules were written incorrectly. The previous rules were written for “telecommunications” services such as phone lines, the court said, whereas broadband Internet had been classified as an “information” service.
