Read the story August 15, 2006 -- Third Circuit Court of Appeals three judge panel declares law banning 'lewd behavior' in businesses with liquor licenses unconstitutional. Thus clearing the road for all nude dancing at bars and taverns. What will bottle clubs do in response to this finding of the panel? In June 2004 the U.S. Supreme Court clarified the "speedy judicial review" controversy by ruling that local municipalities did not have to give porn store owners special preference or 'put them at the head of the line' when reviewing their appeals on zoning ordinances. Re-enforcing a municipality's right to regulate sexually oriented businesses.
PORNOGRAPHY can be found in many forms and many locations: ARE THE STATE OBSCENITY LAWS BEING ENFORCED IN YOUR AREA? Conduct a survey of your community and you may be surprised by what you discover! Video and convenience stores -- Take a close look at your local stores, you may be surprised to see that MANY local video stores have back rooms with HARDCORE pornography videos available. Many times the only thing separating you and your children from this trash is a swinging door. Reading the state obscenity law, you'd think many of these videos would be illegal . . . which they may be . . . . unfortunately each video would have to be prosecuted and deemed obscene by a jury before they could be removed and the owner of the store cited for distributing obscenity! In our area EVERY SHEETZ convenience store has pornographic magazines available. Why not check your area Sheetz store! Check out Sheetz March 2005 billboard. Sexually oriented businesses (SOBs)-- "As morality declines, outlets of sexual deviance typically ensue in order to take advantage of the profit potential made available by consumers of sexually oriented materials or services. However, sexually oriented businesses require special supervision in order to protect and preserve the health, safety, and welfare of the patrons of such businesses as well as the citizens of the communities in which they locate. The problems deriving from sexually oriented businesses include unlawful sexual activities, sexual transmitted diseases, a deleterious (harmful) effect on surrounding businesses, declining property values in surrounding residential neighborhoods, increased crime and blight and a general downgrading of the quality of life in the areas adjacent to these SOBS. The Court has stated that communities have the right to regulate SOBs in order to minimize or eliminate the adverse secondary effects that are prevalent as a matter of course whenever these types of businesses operate in an unbridled fashion. (Please Note: The Erie Ordinance which allows municipalities to ban sexually oriented businesses was upheld in the United States Supreme Court. Unfortunately the PA Supreme Court declared in December 2002 that because Pennsylvania's Constitution is older and 'offers more freedoms' than the U.S. Constitution the Erie Ordinance is unconstitutional. Thus the Erie Ordinance can be used in all other states except the state where it was originally authored! This leaves municipalities that passed the Erie Ordinance without any protection against sexually oriented businesses. They must now 'begin at the drawing board' and rewrite a zoning and/or licensing ordinance.)
