Getting Your Local Municipalities to Pass Zoning/Licensing to Regulate SOBs

Bucks County --

May 2008 -- Residents continue efforts against Coyotes Club -- but are the local township supervisors listening?

Clarion County--

-- December 2005 -- Meadville City Council pass a zoning and licensing ordinance to regulate sexually oriented businesses.
Spring 2006 -- Synn City is closed!

Jefferson County --

spring 2006 police investigate the viewing booths in the store and find they are not in compliance with the Open Booth Law -- Adult Super Store is closed indefinitely!
This is a perfect example of how a good county district attorney who is truly concerned about the negative impact such businesses have on his community can use existing laws to reign in or close these businesses!

June 2007 -- licensing ordinance has been passed and the Adult Super Store must comply -- police background checks for all employees; it can only be open from 8:00 a.m. to 10:00 p.m. Monday through Saturday and must be closed on Sundays and all legal holidays.

Lawrence County --
Pulaski Township --
August 2004 -- PA Supreme Court refuses to hear final appeal of owner of Adultland XXX -- licensing ordinance stays in force and becomes a model for other municipalities!  

October 2005 -- Adultland XXX illegally opened on Columbus Day -- township supervisors vote to close the 'business' down for 30 days. 

June 2006 -- Adultland XXX illegally opened on Flag Day -- on September 11 the township supervisors vote to close Adultland for one year.  Owner appeals the decision.
Victories Against Sexually Oriented Businesses in western PA!

May/June 2007 -- Appeal is heard in New Castle and the judge rules that Adultland XXX was not in compliance with the ordinance when it was open on Flag Day 2006.   Of course, they will appeal the ruling again.

November 19, 2008 --  Commonwealth Court ruled in favor of a sexually oriented business which faced closure for one year. Adultland XXX had been illegally opened on Columbus Day 2005 and was again open on Flag Day 2006. The township licensing ordinance regulating sexually oriented businesses forbids such businesses from being open on legal holidays.  The question before the court was whether Flag Day is a 'legal holiday.'  Judge Mary Hannah Leavitt said the ordinance was too vague because the township had invoked an 1893 state banking law to determine which holidays were 'legal.'  The township solicitor has said the ordinance will be amended to reflect the court's decision.
