Federal Court Ruling Allows Boyertown Students’ Delusion to Continue

(Harrisburg) —  A three-judge panel of the Third Circuit has ruled against the biological fact that there are only two sexes – male and female – and that each deserve their own private space.   This decision places students in the Boyertown School District at risk from those who would take advantage of the school’s policy allowing students to use the bathroom and locker rooms that correspond to their gender identity.  The American Family Association of Pennsylvania (AFA of PA), a statewide child advocacy organization, is appalled by this decision.

“The concerns of the plaintiffs have been totally ignored and they are being treated as second class citizens in the school’s and, now the court’s, decision to force those students to either use the bathroom and locker room with the opposite sex present or use a single-user bathroom.  Why should these students be forced to use a single-user bathroom and not the students who identify as transgender?” questioned Diane Gramley, president of the AFA of PA.

Additionally, the Third Circuit panel’s ruling reveals they are confused about the transgender issue.  Statements by members of the panel confirm that they are comparing this issue to the segregation issue.  Judge Theodore McKee compared statements by the plaintiffs’ attorney to those that could have been made during the Brown v. Board of Education decision which dealt with racial segregation.

“No one is born transgender, anymore than they are born homosexual.  The question that is being ignored and which harms the students who identify as transgender is what are the underlying psychological problems which create this confused thinking.  To affirm this confusion in students who identity as transgender does them a great disservice.  In turn, trying to convince students who do not want to share bathrooms and locker rooms with the opposite sex that they are hateful and bigoted is harmful to them.  This is all part of an agenda to change society’s views on sexuality,” concluded Gramley.

According to the DSM-5, as many as 98% of gender confused boys and 88% of gender confused girls eventually accept their biological sex after naturally passing through puberty. (See page 455 re: rates of persistence of gender dysphoria.)
